Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ConvertFly platform ("Service"), operated by DIZZUS GmbH, a company incorporated under Swiss law with its registered office in Zug, Switzerland ("we", "us", "Company").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

ConvertFly is a cloud-based file conversion service. Users can convert files between 150+ formats via the web interface or REST API. Converted files are stored temporarily and automatically deleted 24 hours after creation.

2. Accounts & Registration

You may use the Service without an account for up to 10 free conversions per day. To access paid features, API access, or higher limits, you must create an account via Clerk authentication (email, Google, or GitHub).

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

3. Credits & Pricing

The Service uses a credit-based pricing model. Credits are consumed per conversion operation. Credit costs vary by conversion type (see Pricing for details).

  • Packages: One-time credit purchases. Package credits do not expire.
  • Subscriptions: Monthly credit allocations. Subscription credits reset each billing cycle and do not roll over.
  • Free tier: 10 free conversions per day, no account required.

All prices are displayed in USD. Payments are processed securely by Stripe. All sales are final — no refunds are issued for unused credits except where required by applicable law.

4. Acceptable Use

You agree not to:

  • Upload files that contain malware, viruses, or malicious code;
  • Use the Service for illegal purposes or to process illegal content;
  • Attempt to circumvent rate limits, authentication, or security mechanisms;
  • Reverse engineer, decompile, or disassemble the Service;
  • Resell or redistribute the Service without our written consent;
  • Use automated means to abuse the free tier or create multiple accounts to circumvent limits.

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

5. File Handling & Data Retention

Files uploaded to ConvertFly are processed on our infrastructure (AWS eu-central-1 and dedicated conversion workers). Uploaded files and conversion outputs are stored temporarily in Amazon S3 and automatically deleted 24 hours after creation. Import files are deleted immediately after the conversion completes.

We do not access, review, or analyze the content of your files. File processing is fully automated.

6. API Usage

Paid accounts may access the ConvertFly API using API keys generated in the dashboard. API usage is subject to rate limits. You are responsible for securing your API keys. We are not liable for unauthorized use of your API keys.

7. Intellectual Property

You retain all rights to the files you upload. We claim no ownership or license over your content. The ConvertFly name, logo, and Service are the property of DIZZUS GmbH.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind. We may perform maintenance, updates, or modifications that temporarily affect availability.

9. Limitation of Liability

To the maximum extent permitted by law, DIZZUS GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Termination

You may stop using the Service at any time. You may delete your account by contacting us. We may suspend or terminate your access for violation of these Terms or for any reason with 30 days' notice for paid accounts.

Upon termination, your files are deleted and remaining credits are forfeited, unless otherwise required by law.

11. Modifications

We may update these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Zug, Switzerland, unless mandatory consumer protection laws of your country of residence provide otherwise.
